These Terms of Reference outline the standard working conditions, payment terms, and cancellation policies applicable to all projects undertaken by Jacob Stærk Barkhage, operating as a producer, editor, creative director, drone pilot and cinematographer.

Scope of Services

​

Jacob Stærk Barkhage operates in two primary capacities:

1. Producer – Managing and delivering media projects. This includes the subcontracting of specialized professionals such as colorists, sound designers, camera assistants, and others, as needed to fulfill the scope of the production.

2. Cinematographer, editor, drone pilot or director – Engaging as freelancer on external projects, hired by other production companies, agencies, or individuals.

All services will be delivered in accordance with mutually agreed project scopes and budgets, formalized in written agreements or confirmed bookings.

Cancellation & Postponement Policy

 

Once production dates have been confirmed, they are binding. A production date refers to a filming day confirmed in writing (typically via email).

In case of postponement, the following fees apply:
 

- More than 21 days before: 25% billed.
- 7–21 days before: 50% of the daily rate billed.
- Less than 7 days before: 100% of the daily rate billed.

In case of cancellation:
- More than 30 days before: 25% billed.
- 14-30 days before: 50% of the daily rate billed.
- Less than 14 days before: 100% of the daily rate billed.

Postponement means that new dates are set within two weeks from the date of postponement. Failure to do so means the production days are cancelled.

Any non-refundable cost for travel arrangements and/or sub-contractors will be invoiced to the client in total. This also relates to postponements unless the payments can be transfered to the new dates.
 

This includes but is not limited to talent, subcontracted crew (e.g. gaffer, director, camera assistant), hired equipment as well as travel costs.​​

Subcontractor Fees

If subcontractors have been engaged for a project, the client is responsible for any cancellation or postponement fees in accordance with each subcontractor’s own terms. This may result in up to 100% of their agreed fee being invoiced.

Payment Terms

​

• Payment is due within the agreed-upon period from the invoice date (typically 14 unless otherwise specified).
   

• Late payments will incur the following penalties:

  • 5% interest per started month, beginning from day 7 after the payment deadline.

  • A reminder fee of 100 NOK per reminder. Payment reminders are issued weekly until the balance is settled.

Agreement & Acceptance

By commissioning services from Jacob Stærk Barkhage, the client acknowledges and accepts these terms. A confirmed booking is defined as any project or engagement that has been agreed upon in writing, including but not limited to email confirmations, signed contracts, or written message exchanges.

Additional conditions specific to individual projects may be outlined in written agreements or email confirmations, and will be considered binding once agreed upon by both parties.
