Terms of Reference
These Terms of Reference outline the standard working conditions, payment terms, and cancellation policies applicable to all projects undertaken by Jacob Stærk Barkhage, operating as a Filmmaker, Producer, and Cinematographer.
Scope of Services
Jacob Stærk Barkhage operates in two primary capacities:

Producer – Managing and delivering larger-scale film and video projects. This includes the subcontracting of specialized professionals such as colorists, sound designers, camera assistants, and others, as needed to fulfill the scope of the production.

Cinematographer – Engaging as Director of Photography on external projects, hired by other production companies, agencies, or individuals.

All services will be delivered in accordance with mutually agreed project scopes and budgets, formalized in written agreements or confirmed bookings.
Cancellation & Postponement Policy
In the event a client chooses to cancel a confirmed booking or project,
the following fee structure applies:

30 days or more before the start date: 25% of the total project fee will be invoiced.

7–29 days before the start date: 50% of the total project fee will be invoiced.

Less than 7 days before the start date: 75% of the total project fee will be invoiced.
For long-term / Multi-Phase Projects
If a project is divided into multiple payments or milestones, the cancellation policy applies only to the upcoming scheduled payment or phase at the time of cancellation.
In the event a client chooses to postpone a confirmed booking or project, the following fee structure applies:

Costs relating to the project shall be refunded in total unless they can be transferred with the project. Postponements may be no more than three months from the intended start date or they shall be considered as cancellations . This such case the above policies apply.

A project may be postponed no more than two times or it shall be considered cancelled.

In the event that a project is postponed with less than 7 days before the start date, 25 percent of the total fee will be invoiced to compensate for the empty schedule.
Subcontractor Fees
If subcontractors have been engaged for a project, the client is responsible for any cancellation or postponement fees in accordance with each subcontractor’s own terms. This may result in up to 100% of their agreed fee being invoiced.
Payment Terms

Payment is due within the agreed-upon period from the invoice date (typically 14 or 30 days, unless otherwise specified).

Late payments will incur the following penalties:

5% interest per started month, beginning from day 7 after the payment deadline.

A reminder fee of 100 NOK per reminder. Payment reminders are issued weekly until the balance is settled.

Agreement & Acceptance
By commissioning services from Jacob Stærk Barkhage, the client acknowledges and accepts these terms. A confirmed booking is defined as any project or engagement that has been agreed upon in writing, including but not limited to email confirmations, signed contracts, or written message exchanges.
Additional conditions specific to individual projects may be outlined in written agreements or email confirmations, and will be considered binding once agreed upon by both parties.
