These Terms of Reference outline the standard working conditions, payment terms, and cancellation policies applicable to all projects undertaken by Jacob Stærk Barkhage, operating as a producer, editor, creative director, drone pilot and cinematographer.

Scope of Services

​

Jacob Stærk Barkhage operates in to primary capacities:

1. Producer – Managing and delivering larger-scale film and video projects. This includes the subcontracting of specialized professionals such as colorists, sound designers, camera assistants, and others, as needed to fulfill the scope of the production.

2. Cinematographer, dditor, Drone Pilot or Director – Engaging as freelancer on external projects, hired by other production companies, agencies, or individuals.

All services will be delivered in accordance with mutually agreed project scopes and budgets, formalized in written agreements or confirmed bookings.

Cancellation & Postponement Policy

 

Once production dates have been confirmed, they are binding. A production date refers to a filming day confirmed either in writing (typically via email) or verbally between client and supplier.

In case of postponement, the following fees apply:
 

- More than 21 days before: 0% billed.
- 7–21 days before: 50% of the daily rate billed.
- Less than 7 days before: 100% of the daily rate billed.

In case of cancellation:
- More than 30 days before: 0% billed.
- 7–30 days before: 50% of the daily rate billed.
- Less than 7 days before: 100% of the daily rate billed.

Postponement means that new dates are set within four weeks from the date of postponement. Failure to do so means the production days are cancelled.

Any non-refundable cost for travel arrangements and/or sub-contractors will be invoiced to the client in total. This also relates to postponements unless the payments can be transfered to the new dates.
 

This includes but is not limited to talent, subcontracted crew (e.g. gaffer, director, assistant), equipment as well as travel costs, e.g. hotels, plane tickets etc.

Clients cannot be held financially responsible for any external commitments made before production days have been agreed on between Stærk Film AS and the client.

For long-term / Multi-Phase Projects
 

If a project is divided into multiple payments or milestones, the cancellation policy applies only to the upcoming scheduled payment or phase at the time of cancellation.

Subcontractor Fees

If subcontractors have been engaged for a project, the client is responsible for any cancellation or postponement fees in accordance with each subcontractor’s own terms. This may result in up to 100% of their agreed fee being invoiced.

Payment Terms

​

• Payment is due within the agreed-upon period from the invoice date (typically 14 unless otherwise specified).
   

• Late payments will incur the following penalties:

  • 5% interest per started month, beginning from day 7 after the payment deadline.

  • A reminder fee of 100 NOK per reminder. Payment reminders are issued weekly until the balance is settled.

 

Transportation cost

Transportation costs come on top of the quoted price and refer to both the time it takes to travel and the costs relating to the journey. 

​

This is typically hotels, food, airline tickets, car hire etcetera. But for overseas travels other costs such as visas, carnets and vaccinations my be incurred as well. 

​

Transportation costs is the time it takes to travel fromØrsta to the location of filming and back. Travel time is invoiced by 500 NOK per hour but may not exceed 4.000 NOK per day/ 24 hours. 

​

The state rates for public employees applies for driving, currently at 5 NOK / km.

Agreement & Acceptance

By commissioning services from Jacob Stærk Barkhage, the client acknowledges and accepts these terms. A confirmed booking is defined as any project or engagement that has been agreed upon in writing, including but not limited to email confirmations, signed contracts, or written message exchanges.

Additional conditions specific to individual projects may be outlined in written agreements or email confirmations, and will be considered binding once agreed upon by both parties.

1.    Producer – Managing and delivering full-scale film and video productions. This may include hiring specialists such as colorists, sound designers, or camera assistants as needed.
 

 2.    Freelance Cinematographer, Editor, Drone Pilot, or Director – Working on external projects for production companies, agencies, or private clients.

All services are delivered according to the agreed project scope and budget, confirmed through written agreements or bookings.

    Cancellation & Postponement Policy

Once production dates are confirmed (in writing or verbally), they are considered binding.
 

Postponement fees:

• More than 21 days before: 0% charged

• 7–21 days before: 50% of the daily rate charged

• Less than 7 days before: 100% of the daily rate charged

Clients are not financially responsible for any external commitments made before production dates have been confirmed between Stærk Film AS and the client.

    Long-Term or Multi-Phase Projects

If a project is divided into multiple stages or payments, the cancellation policy applies only to the next scheduled phase or payment at the time of cancellation.

    Subcontractor Fees
If subcontractors are engaged, the client is responsible for any cancellation or postponement fees according to each subcontractor’s terms. This may include up to 100% of their agreed fee.
 

    Payment Terms

 

Payment is due within the agreed period stated on the invoice (typically 14 days, unless otherwise specified).
 

Late payments may incur:

• 12,5% interest per year, starting after the due date.

•    A reminder fee of 100 NOK per reminder. Reminders are sent weekly until payment is received.

    Travel & Transportation Costs
Travel and related costs are billed in addition to the quoted project price. These may include hotels, food, flights, car rental, and for international work, visas, carnets, or vaccinations.

Travel time is billed from Ørsta to the filming location and back at 500 NOK per hour, up to a maximum of 4,000 NOK per day (24 hours).

Driving is charged according to the official Norwegian state rate, currently 5 NOK per km.
 

    Agreement & Acceptance

By confirming a booking or commissioning services from Jacob Stærk Barkhage, the client agrees to these Terms of Reference.

Specific changes to a project may be included in writing and will become binding once both parties confirm.
